By using this site you are agreeing to follow and abide by our terms and conditions and privacy policy. Throughout these terms, we will refer to ourselves as ‘bake-my-day.co.uk’, ‘Bake My Day (Norfolk)’, ‘us’, ‘we’ or ‘our’.
We may revise the Terms and conditions and Privacy Policy at any time without notice to you.
1. PRICES AND DESCRIPTION OF GOODS
All prices are correct as stated on the website, however we reserve the right to revise the price of goods at any time, without notice. The content of this website has been carefully prepared to ensure all goods have been described properly. However, goods may differ slightly to those described, i.e – weights, sizes and dimensions are approximate and may vary slightly.
2. MINIMUM AND MAXIMUM ORDERS
Our minimum order is one box. There is no maximum order amount.
3. AVAILABILITY OF GOODS
Orders are subject to acceptance and availability. If for any reason the Goods you have ordered are not available on that day, we reserve the right to substitute a different item. For example, if a flavour you have chosen is unavailable we may substitute it for another flavour. We will contact you by e-mail or phone (provided you have supplied your contact details) to make you aware of any substitutions.
4. PAYMENT
We accept payment by credit or debit card online. We use a trusted and secure payment gateway (provided by Stripe). Alternatively you can pay by direct BACs transfer, details are given during checkout, however, please note that no product/s will be sent until funds have cleared into our bank account.
5. DELIVERY CHARGES AND SERVICE
Delivery charges vary depending on what is in your basket, prices start from £5.47, increasing as the basket value increases to a total of £45 when delivery becomes free. We offer a Free Local Delivery service within 5 miles of NR14, or alternatively you can arrange to Pick-up in person, please select your option on the checkout page.
6. DISPATCH AND DELIVERY
Bake My Day (Norfolk) can only deliver to addresses within the UK.
All orders are dispatched as soon as possible, if you order before 2pm we hope to dispatch the same day depending on volume of orders. Orders placed after 2pm will dispatched the following day. At the moment we are unable to deliver on a specific day.
Because our products are chunky and delicious, they are slightly too big to fit through standard letter boxes and so orders will require someone to be in when it arrives. If you are unable to be at the delivery location, please leave a note on the checkout page to let Royal Mail know of a safe place it can be left in case you are out.
We will send the goods to the address specified for delivery in your order. It is very important that this address is accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.
Delivery times for First Class Delivery are usually 1-2 working days after dispatch. We cannot guarantee delivery dates as they are subject to Royal Mail delays. Orders at peak periods for postage (e.g. Christmas, Easter, Valentines Day etc. ) may carry a greater risk of delay therefore we would advise that you allow more time for your delivery during these periods.
You will become the owner of the goods once you have placed the order, payment has cleared and the goods have been delivered to you or your chosen recipient. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or damage. Suggested storage instructions are included for your benefit, and can also be found in our FAQ section.
7. CONTRACT
Full payment is required when you order. By paying for the goods, you are committing to a purchase. Our acceptance of your order completes the contract between us.
8. RISK AND OWNERSHIP
Risk of damage to or loss of the goods is passed to you upon your receipt of the goods. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
9. CANCELLATION RIGHTS
The Distance Selling Regulations state that consumers do not have the legal right to cancel orders of made-to-order items – this includes all of our products. However, Bake My Day (Norfolk) will accept cancellations only if the cancellation is requested in writing within 12 hours of placing the order. Cancellation in writing will need to be sent to our email address hello@bake-my-day.co.uk
10. CANCELLATION BY US
We reserve the right to cancel the contract between you and us if:
- • We have insufficient stock to deliver the goods you have ordered
- • We do not deliver to your area (delivery is within the UK only)
- • One or more of the goods you ordered was incorrectly listed due to a typographical error or an error in the pricing information
If we do cancel your contract we will notify you by e-mail and will refund any payment you have made to us within 15 days of your order.
11. LIABILITY
11.1 If you or the intended recipient do not receive goods ordered by you within 7 days of the date for which you ordered them, we will have no liability to you unless you notify us in writing at our contact email address of the problem within 30 days of the date on which you ordered the goods
If you notify a problem to us under this condition, our only obligation will be, at your option:
- To send a new box at our earliest convenience;
- To refund to you the amount paid by you for the goods in question in whatever way we choose.
Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.
11.2 Our postal boxes are slightly to large for standard UK letterboxes, however, Royal Mail will arrange to leave in a safe place if necessary. If it is possible for the box to be chewed by dogs/cats/other pets. Chocolate is very harmful to pets if ingested. We have clearly stated this information on all items on our website, and ask customers to consider this information before sending a box to a household with pets. Bake My Day (Norfolk) will not be liable for any harm caused to pets through ingestion of brownies.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
12. NOTICES
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to us by email to hello@bake-my-day.co.uk.
All notices from us to you will be displayed on our website from time to time.
13. CHANGES TO LEGAL NOTICES
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
14. INVALIDITY
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
15. PRIVACY
You acknowledge and agree to be bound by the terms of our Privacy Policy.
16. THIRD PARTY RIGHTS
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
17. JURISDICTION
These terms and conditions will be governed by the laws of England and Wales and by using this website you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
18. INTELLECTUAL PROPERTY
All of the content on the site, including text and pictures, are subject to copyright and other intellectual property rights held by Bake My Day (Norfolk). The entire content of the site is copyrighted under applicable copyright laws.
The use of our site and it’s content is intended for the personal and non- commercial use by the users of our site.
19. USE OF THE SITE
You may view, download and print documents and graphics from our website including our Terms & Conditions, Privacy Policy and FAQ’s (The Documents), provided that: (a) (The Documents) may be used solely for personal, informational and non-commercial purposes; and (b) (The Documents) may not be modified or altered in any way.
You may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from this website in whole or in part without the express authorisation of Bake My Day (Norfolk). All images on the website are the property of Bake My Day (Norfolk) and may not be used for commercial purposes without explicit written permission from Bake My Day (Norfolk). Bake My Day (Norfolk) reserves complete and full intellectual property rights in any content you download, print, reproduce, distribute or store from this website.
20. CYBER SECURITY
We always try to ensure that our website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is the responsibility of the consumer to ensure they have the right equipment/software to use the website. We will not be liable for any loss or damage which may arise to computer equipment as a result of using this website, unless as a result of our negligence.
